1. Acceptance
By accessing RDVnow, creating an account, using a public booking page, widget, link, QR code, internal interface or any feature related to the platform, you agree to be bound by these Terms of Use.
If you use RDVnow on behalf of a business, you represent that you have the authority required to bind that business.
2. Definitions and nature of the service
RDVnow is a technology platform that notably enables the management of services, availability, clients, bookings, confirmations, cancellations, rescheduling, reminders, communications, satisfaction reviews, integrations, receipts and invoices.
- “Subscriber” means any business, professional or organization using RDVnow in connection with its activity.
- “End customer” means any person who books, confirms, cancels, reschedules or interacts with a subscriber through RDVnow.
- RDVnow is not a party to the contract between the subscriber and its end customer and does not replace the subscriber’s commercial, legal, tax, regulatory or professional obligations.
3. Accounts, access and security
You must provide accurate, complete and up-to-date information. You are responsible for the confidentiality of your credentials, passwords, secure links, codes, tokens and access. You must notify us without delay of any unauthorized access, suspicious use or security incident affecting your account.
4. Subscriber and end customer obligations
Subscriber
- assumes responsibility for the legality of its activity, services, prices, taxes and policies;
- remains solely responsible for the data it collects and the consents it obtains;
- is responsible for messages, reminders, follow-ups, SMS and emails sent in its name;
- manages its employees, roles, access, schedules, availability and configurations;
- must comply with the laws applicable to its sector of activity.
End customer
- must provide accurate and up-to-date information;
- must not impersonate another person;
- must not book in a fraudulent, abusive or automated way;
- must comply with the conditions applicable at the relevant subscriber’s business.
Important:
RDVnow provides software infrastructure. The subscriber remains solely responsible for the compliance of its activity, its communications and its relationship with its own customers.
5. Prohibited uses
- violate any law, regulation or contractual obligation;
- send spam, unlawful or unauthorized messages;
- bypass security, authentication, limitation or capacity mechanisms;
- scrape, harvest or massively extract data without written authorization;
- introduce malicious scripts, viruses, bots or harmful automations;
- use the service in an emergency, high-risk or mission-critical context;
- harm the rights, reputation or security of RDVnow, a subscriber, an end customer or a third party.
6. Public pages, widgets and communications
RDVnow may provide or enable the use of public booking pages, widgets, links, QR codes, integrations and flows allowing an end customer to book or interact with a subscriber.
The subscriber remains solely responsible for the content displayed, the domains used, the information provided to its customers, the consents obtained and the lawfulness of communications sent in its name, including emails, SMS, reminders and follow-ups.
7. Subscriptions, payments and fees
Certain service features may be paid. Prices, taxes, options, credits, modules, packs, additional employees or other applicable fees are those displayed or agreed upon at the relevant time.
Unless mandatory law or a specific written commitment provides otherwise, paid amounts are non-refundable. Any payment default may result in limitation, suspension or termination of access to the service, without prejudice to any other available remedy.
8. Intellectual property and availability
The service, its code, structure, interfaces, visual elements, databases, texts, documentation, features and arrangement are protected by applicable intellectual property laws.
RDVnow strives to provide a useful and reliable service, but does not guarantee that it will be uninterrupted, error-free, compatible with every environment or available at all times. RDVnow may modify, fix, suspend, remove or evolve the service at any time.
9. Limitation of liability and indemnification
To the maximum extent permitted by law, RDVnow is provided “as is” and “as available”. RDVnow does not guarantee the total absence of errors, continuous availability, perfect delivery of emails or SMS, or fitness for a particular purpose.
RDVnow is notably not liable for no-shows, cancellations, data entry errors, configuration errors, scheduling conflicts, acts or omissions of a subscriber, conduct of an end customer, Internet interruptions, or failures of third-party providers.
To the maximum extent permitted by law, RDVnow’s total cumulative liability relating to the service is limited to the lesser of the following amounts: the sums actually paid to RDVnow by the claiming party during the twelve (12) months preceding the event at issue, or CAD 100 if no amount was paid.
The subscriber agrees to defend, indemnify and hold harmless RDVnow, its officers, employees, affiliates, providers and partners from any claim, loss, damage, fine, sanction, cost or reasonable expense arising from its activity, its data, its communications, its content, its integrations or a breach of these terms.
10. Governing law and contact
These terms are governed by the laws applicable in the Province of Quebec and the federal laws of Canada applicable in Quebec. Subject to mandatory rights that may apply, any dispute shall be submitted to the competent courts of the judicial district of Montreal, Quebec.
11. Who we are and roles
RDVnow is a platform operated under the RDVnow brand and accessible notably at rdvnow.ca. RDVnow processes certain information for its own purposes, including account management, authentication, security, billing, support and platform improvement.
When a subscribed business uses RDVnow to manage its clients, bookings, communications and documents, that business remains responsible for its relationship with its own customers, the required consents and the lawfulness of its processing.
12. Personal information that may be collected
- name, email address, phone number, preferred language;
- account, login, authentication and verification data;
- business, professional profile and employee information;
- services, availability, schedules, bookings, confirmations, cancellations and rescheduling;
- internal notes, client notes, preferences, comments and satisfaction reviews;
- history of reminders, emails, SMS, receipts, invoices, payment statuses and technical logs;
- IP address, browser, device, session and security or abuse-prevention data.
13. Use of information
Personal information may be used to create, manage and secure accounts, enable bookings and calendar management, send confirmations and reminders, manage subscriptions, prevent fraud, maintain the platform, respond to requests, handle incidents and comply with our legal, tax, regulatory, contractual and security obligations.
Law 25:
RDVnow states that it implements reasonable governance, security, access limitation and incident management measures adapted to the nature of the service and the sensitivity of the information processed.
14. Cookies, hosting and providers
RDVnow may use cookies, session identifiers and similar technologies in order to provide authentication, the technical operation of the service, the storage of certain preferences, security, error detection and abuse prevention.
RDVnow indicates primary data hosting in Toronto, Ontario, Canada. Certain technical providers or subcontractors may nevertheless process, store, transmit, back up or make certain data accessible from other jurisdictions where necessary for the operation of the service.
RDVnow may disclose certain information to providers necessary for operating the service, notably for hosting, storage, security, payments, emails, SMS, logging, support, authentication and fraud prevention.
15. Security, retention and incidents
RDVnow implements reasonable administrative, organizational, contractual and technical safeguards designed to protect personal information against loss, theft, unauthorized access, unauthorized disclosure, alteration, destruction or unlawful use.
Information is retained for as long as reasonably necessary for the intended purposes or for any period permitted or required by law. At the end of the applicable period, it may be deleted, destroyed, archived, de-identified or anonymized depending on the context.
In the event of a privacy incident, RDVnow may take any reasonable measure to contain the incident, reduce risks, investigate, preserve evidence, fix vulnerabilities, document the event and, where required, provide the notifications mandated by law.
16. Your rights and contact
Subject to legal limits and to RDVnow’s exact role in the processing, you may request access to your personal information, correction, withdrawal of consent where applicable, or submit a complaint relating to personal information protection.
Where the data is mainly handled on behalf of a subscribed business, RDVnow may redirect the request to that business or cooperate with it in responding.

In the event of any discrepancy between language versions of this page, the French version prevails to the extent permitted by law.
